House FISA investigation memo suggests there are alligators in the ‘deep state’ swamp
The FISA-related memo from Republicans associated with the House Intelligence Committee has been released to the public:

The four-page memo written by Republicans on the House Intelligence Committee contends that FBI officials used the unverified Steele dossier to obtain a secret warrant to spy on a Trump associate, according to a source with direct knowledge of the document.
The memo, based on information provided by the FBI and the Department of Justice, may be released Friday, with White House approval. It asserts that the FBI used the dubious dossier to obtain a warrant to spy on Trump campaign adviser Carter Page. Other Trump campaign associates were also spied on during the campaign.
The Daily Caller’s source made clear that the dossier was used to procure a warrant even after it was clear that the document was paid for by the Democratic National Committee and Hillary Clinton’s presidential campaign.
The FBI, according to the memo, did not disclose information on the funding and origins of the dossier in a Foreign Intelligence Surveillance Act (FISA) application submitted to a federal judge in September 2016.
The dossier claimed President Trump had connections to Russia and that Trump’s campaign engaged in possible coordination with the Kremlin in attempts to meddle in the 2016 election.
The Democrats hired the Washington research firm Fusion GPS, co-founded by former journalist Glenn Simpson, to produce the dossier. A former British intelligence (MI6) officer, Christopher Steele, researched and wrote the dossier, which is comprised of 17 separate memos dated from June 20, 2016 to Dec. 13, 2016. http://dailycaller.com/2018/02/02/fisa-memo-intelligence-committee-trump-dossier/
The release of the FISA memo by House Intelligence Committee Chairman Devin Nunes (R-Calif.) has been criticized for many reasons, including the fact that it is a limited document.
Here are some details from a news report on what was released:

* The Steele dossier formed an essential part of the initial and all three renewal FISA applications against Carter Page.
* Andrew McCabe confirmed that no FISA warrant would have been sought from the FISA Court without the Steele dossier information.
* The four FISA surveillance applications were signed by, in various combinations, James Comey, Andrew McCabe, Sally Yates, Dana Boente, and Rod Rosenstein.
* The FBI authorized payments to Steele for work on the dossier. The FBI terminated its agreement with Steele in late October when it learned, by reading an article in Mother Jones, that Steele was talking to the media.
* The political origins of the Steele dossier were known to senior DOJ and FBI officials, but excluded from the FISA applications.
* DOJ official Bruce Ohr met with Steele beginning in the summer of 2016 and relayed to DOJ information about Steele’s bias. Steele told Ohr that he, Steele, was desperate that Donald Trump not get elected president and was passionate about him not becoming president.
The FBI and Justice Department mounted a months long effort to keep the information outlined in the memo out of the House Intelligence Committee’s hands. This memorandum provides Members an update on significant facts relating to the Committee’s ongoing investigation into the Department of Justice (DOJ) and Federal Bureau of Investigation (FBI) and their use of the Foreign Intelligence Surveillance Act (FISA) during the 2016 presidential election cycle. Our findings, which are detailed below, 1) raise concerns with the legitimacy and legality of certain DOJ and FBI interactions with the Foreign Intelligence Surveillance Court (FISC), and 2) represent a troubling breakdown of legal processes established to protect the American people from abuses related to the FISA process.
Investigation Update
On October 21, 2016, DOJ and FBI sought and received a FISA probable cause order (not under Title VII) authorizing electronic surveillance on Carter Page from the FISC. Page is a US citizen who served as a volunteer advisor to the Trump presidential campaign. Consistent with requirements under FISA, the application had to be first certified by the Director or Deputy Director of the FBI. It then required the approval of the Attorney General, Deputy Attorney General (DAG), or the Senate-confirmed Assistant Attorney General for the National Security Division.
The FBI and DOJ obtained one initial FISA warrant targeting Carter Page and three FISA renewals from the FISC. As required by statute (50 U.S.C. 1805(d)(1)), a FISA order on an American citizen must be renewed by the ISC every 90 days and each renewal requires a separate finding of probable cause. Then-Director James Comey signed three FISA applications in question on behalf of the FBI, and Deputy Director Andrew McCabe signed one. Sally Yates, then-Acting DAG Dana Boente, and DAG Rod Rosenstein each signed one or more FISA applications on behalf of DOJ.
Due to the sensitive nature of foreign intelligence activity, FISA submissions (including renewals) before the ISC are classified. As such, the public’s confidence in the integrity of the FISA process depends on the court’s ability to hold the government to the highest standard — particularly as it relates to surveillance of American citizens. However, the rigor in protecting the rights of Americans, which is reinforced by 90-day renewals of surveillance orders, is necessarily dependent on the government’s production to the court of all material and relevant facts. This should include information potentially favorable to the target of the FISA application that is known by the government. In the case of Carter Page, the government had at least four independent opportunities before the FISC to accurately provide an accounting of the relevant facts. However, our findings indicate that, as described below, material and relevant information was omitted.
1) The “dossier” compiled by Christopher Steele (Steele dossier) on behalf of the Democratic National Committee (DNC) and the Hillary Clinton campaign formed an essential part of the Carter Page FISA application. Steele was a longtime FBI source who was paid over $160,000 by the DNC and Clinton campaign, via the law firm Perkins Coie and research firm Fusion GPS, to obtain derogatory information on Donald Trump’s ties to Russia.
a) Neither the initial application in October 2016, nor any of the renewals, disclose or reference the role of the DNC, Clinton campaign, or. any party/campaign in funding Steele’s efforts, even though the political origins of the Steele dossier were then known to senior and FBI officials.
b) The initial FISA application notes Steele was working for a named US. person, but does not name Fusion GPS and principal Glenn Simpson, who was paid by a US. Law firm (Perkins Coie) representing the DNC (even though it was known by DOI at the, time that political actors were involved with the Steele dossier). The application does not mention Steele was ultimately working on behalf of — and paid by — the DNC and Clinton campaign, or that the FBI had separately authorized payment to Steele for the same information.
2) The Carter Page FISA application also cited extensively a September 23, 2016, Yahoo News article by Michael Isikoff, which focuses on Page’s July 2016 trip to Moscow. This article does not corroborate the Steele dossier because it is derived from information leaked by Steele himself to Yahoo News. The Page FISA application incorrectly assesses that Steele did not directly provide information to Yahoo News. Steele has admitted in British court filings that he met with Yahoo News — and several other outlets – in September 2016 at the direction of Fusion GPS. Perkins Coie was aware of Steele’s initial media contacts because they hosted at least one meeting in Washington DC. in 2016 with Steele and Fusion GPS where this matter was discussed.”
a) Steele was suspended and then terminated as an FBI source for what the FBI defines as the most serious of violations — an unauthorized disclosure to the media of his relationship with the FBI in an October 30, 2016, Mother Jones article by David Corn. Steele should have been terminated for his previous undisclosed contacts with Yahoo and other outlets in September — before the Page application was submitted to the FISC in October — but Steele improperly concealed from and lied to the FBI about those contacts.
b) Steele’s numerous encounters with the media violated the cardinal rule of source handling — maintaining confidentiality — and demonstrated that Steele had become a less than reliable source for the FBI.
a) During this same time period, Ohr’s wife was employed by Fusion GPS to assist in the cultivation of opposition research on Trump. Ohr later provided the FBI with all of his wife’s opposition research, paid for by the DNC and Clinton campaign via Fusion GPS. The Ohrs’ relationship with Steele and Fusion GPS was inexplicably concealed from the FISC.
4) According to the head of the counterintelligence division, Assistant Director Bill Priestap, corroboration of the Steele dossier was in its “infancy” at the time of the initial Page FISA application. After Steele was terminated, a source validation report conducted by an independent unit within FBI assessed Steele’s reporting as only minimally corroborated. Yet, in early January 2017, Director Comey briefed President-elect Trump on a summary of the Steele dossier, even though it was — according to his June 2017 testimony – “salacious and unverified.” While the FISA application relied on Steele’s past record of credible reporting on other unrelated matters, it ignored or concealed his
anti-Trump financial and ideological motivations. Furthermore, Deputy Director McCabe testified before the Committee in December 2017 that no surveillance warrant would have been sought from the FISC without the Steele dossier information.5) The Page FISA application also mentions information regarding fellow Trump campaign advisor George Papadopoulos, but there is no evidence of any cooperation or conspiracy between Page and Papadopoulos. The Papadopoulos information triggered the opening of an FBI counterintelligence investigation in late July 2016 by FBI agent Pete Strzok. Strzok was reassigned by the Special Counsel’s Office to FBI Human Resources for improper text messages with his mistress, FBI Attorney Lisa Page (no known relation to Carter Page), where they both demonstrated a clear bias against Trump and in favor of Clinton, Whom Strzok had also investigated. The Steel dossier contained falsehoods and, thus, the FISA investigation was started at least partially because of lies. Officials in the FBI and Justice department saw the partisan angle, but proceeded anyway.
Donald Trump has been contending since 2016 that the government was not investigating Hillary Clinton related to her email and other scandals in an unbiased manner, but that he was being treated unfairly.
While we do not have all the facts related to this and various investigations, nor access to all the supporting materials, several things do seem to be apparent.
Here is my personal, non-legal, assessment of this and related matters:
- Donald Trump did not collude with the Russians. If he did, we have still not seen any real evidence.
- The Democratic party paid for research against Donald Trump that was inaccurate, yet that was an important part of the basis of opening a FISA investigation on him and his campaign.
- Donald Trump has made statements indicating possible obstruction of justice by him, but likely feels that since he was not colluding with the Russians that this investigation was essentially revenge from those who did not want him to be the President of the USA. Thus, he feels that he could not obstruct justice as justice should show he did not collude.
- There are ‘alligators in the swamp.’ Meaning that more and more government officials let their political preferences affect their actions and statements, as opposed to impartially and truthfully doing their jobs.
- Hillary Clinton received special treatment for her mishandling of the State Department emails as her actions appear criminal to me. Others have been prosecuted for less matters than this.
- The Clinton Foundation received money from the Russians and other governments that affected decisions of the federal government while Hillary Clinton was Secretary of State that many in the media want to overlook.
- On various matter, both Donald Trump and Hillary Clinton have not told the truth.
- Corruption in the USA includes intelligence agencies.
- The hypocrisy of much of the press on this Russia-Trump, etc. matter has been blatant.
- The USA needs national repentance as it is otherwise doomed (cf. Daniel 11:39; Habakkuk 2:6-8).
As far as the ‘deep state’ situation, notice something from nearly a year ago:

The scariest new catchphrase of the Trumpera – and we’re only one month in – is the “deep state,” a term borrowed from countries like Turkey and Egypt, where networks of military officers and intelligence operatives control much of the government.
Last week, President Trump complained that “illegal leaks” from the FBI and other intelligence agencies forced him to fire his national security advisor, Michael Flynn.
The leaks revealed that Flynn had secretly discussed U.S. sanctions on Russia with the Russian ambassador, then falsely claimed he hadn’t. The talks didn’t bother Trump; the leaks did.
“The real scandal here is that classified information is illegally given out by ‘intelligence’ like candy,” he tweeted. “The spotlight has finally been put on the low-life leakers! They will be caught!”
Others worried, too. Republican members of Congress condemned the leaks as a misuse of classified information. Critics of the intelligence community, both conservative and liberal, warned that unelected bureaucrats were exerting too much political power.
Was the American deep state, panicked by Trump, revealing itself?
“The intelligence agencies are pretty hard to roll,” a former top CIA official told me last week. “These guys are trained to manipulate people and overthrow governments, and they’re rather good at it.” …

When Gen. Michael Flynn was forced to resign as national security adviser, Bill Kristol purred his satisfaction, “If it comes to it, prefer the deep state to the Trump state.”
To Kristol, the permanent regime, not the elected president and his government, is the real defender and rightful repository of our liberties.
Yet it was this regime, the deep state, that carried out what Eli Lake of Bloomberg calls “The Political Assassination of Michael Flynn.” …

While campaigning, Donald Trump spoke about his need to “drain the swamp.” By that, he meant various interests in (like government employees or politicians) or related to (like lobbyists and government contractors) the US federal government.
Many do not like that.

According to civil right expert and prominent First Amendement {sic} Supreme Court lawyer, Jay Sekulow, what the agencies did by leaking the Trump Administration information was not only illegal but “almost becomes a soft coup”, one which was spurred by the last minute rule-change by Obama, who intentionally made it far easier for leaks to propagate, and next to impossible to catch those responsible for the leaks.
This is his explanation:
There was a sea-change here at the NSA with an order that came from president Obama 17 days before he left office where he allowed the NSA who used to control the data, it now goes to 16 other agencies and that just festered this whole leaking situation, and that happened on the way out, as the president was leaving the office.
Why did the Obama administration wait until it had 17 days left in their administration to put this order in place if they thought it was so important. They had 8 years, they didn’t do it, number one. Number two, it changed the exiting rule which was an executive order dating back to Ronald Reagan, that has been in place until 17 days before the Obama administration was going to end, that said the NSA gets the raw data, and they determine dissemination.
Instead, this change that the president put in place, signed off by the way by James Clapper on December 15, 2016, signed off by Loretta Lynch the Attorney General January 3, 2017, they decide that now 16 agencies can get the raw data and what that does is almost creates a shadow government. You have all these people who are not agreeing with President Trump’s position, so it just festers more leaks.
If they had a justification for this, wonderful, why didn’t they do it 8 years ago, 4 years ago, 3 years ago. Yet they wait until 17 days left.
One potential answer: they knew they had a “smoking gun”, and were working to make it easier to enable the information to be “leaked” despite the clearly criminal consequences of such dissemination.
As this point Hannity correctly points out, “it makes it that much more difficult by spreading out the information among 16 other agencies, if they want to target or take away the privacy rights, and illegally tap the phones, in this case General Flynn, it’s going to be much harder to find the perpetrator.”

This is not unexpected. And leaks, via James Comey, to name one 2017 ‘leaker’ did occur.

We are seeing more and more the result of “secret plots” involving “bitter words.”
The so-called “deep state” in this case is essentially government bureaucrats, along with their willing accomplices in the mainstream media, that feel that they should change the Trump Administration.
From what seems known, in certain instances this has been done in ways that are illegal, partisan, and/or improper.

Deceit by American leaders, Republican and Democrat, is not good.
This will not bode well for the USA.
