US Justice Department allegedly claiming that international treaties surpass US Constitution

It is being claimed that the Justice Department of the USA is arguing that international treaties/law are above the Constitution of the USA:

Justice Department attorneys are advancing an argument at the Supreme Court that could allow the government to invoke international treaties as a legal basis for policies such as gun control that conflict with the U.S. Constitution, according to Sen. Ted Cruz, R-Texas.

Their argument is that a law implementing an international treaty signed by the U.S. allows the federal government to prosecute a criminal case that would normally be handled by state or local authorities.

That is a dangerous argument, according to Cruz.

“The Constitution created a limited federal government with only specific enumerated powers,” Cruz told the Washington Examiner prior to giving a speech on the issue today at the Heritage Foundation.

This is a tricky subject, so let me try to carefully make a couple of comments.

The first is that the government of the USA should keep its word and abide by treaties that it agrees to.

The second is that it would appear legally that the government of USA should never agree to any terms of a treaty that are in conflict with its Constitution. If something truly needs to be agreed to that is in conflict with the Constitution, the Constitution should be changed.

Since those on the US Supreme Court do not uniformly believe that promises must be kept, they may have other opinions.

For decades, many have warned that the USA has subjected its citizens to all types of international jurisdiction based upon treaties (that sometimes have provisions that appear in conflict with the Constitution of the USA) that the government of the USA has agreed to.

There, however, never should be such conflict. Either do not agree to treaty provisions that are in conflict with the Constitution or amend the Constitution.

However, this may not be the way that the US Supreme Court may decide these type of matters.

It has been my view for some time that the USA does not truly abide by its Constitution any more. And its hypocrisy and tactics are being noticed by others. Conflicts between treaties and the Constitution are indicative of hypocrisy, as well as deceit.
