US Supreme Court further gets rid of another right

The US Supreme Court made another decision in favor of the police state and away from that government’s constitution:

June 3, 2013

WASHINGTON — A narrowly divided Supreme Court ruled Monday that police can collect DNA from people arrested but not yet convicted of serious crimes, a tool that more than half the states already use to help crack unsolved crimes.

The case, described by Justice Samuel Alito as “the most important criminal procedure case that this court has heard in decades,” represented a classic test between modern crime-fighting technology and centuries-old privacy rights…

Justice Antonin Scalia wrote an angry dissent for himself and three liberal justices, charging that the decision will lead to an increased use of DNA testing in violation of the Constitution’s protection against unreasonable searches.

“Make no mistake about it: because of today’s decision, your DNA can be taken and entered into a national database if you are ever arrested, rightly or wrongly, and for whatever reason,” Scalia warned. “This will solve some extra crimes, to be sure. So, once again, privacy rights (that are supposedly guaranteed by the US Constitution, as that was one of the arguments the Supreme Court used in favor of legalizing abortion decades ago), are trampled because of the State’s policing powers and interest. This kind of thing was not supposed to be able to happen in the USA. Notice the fourth amendment to the US Constitution, in the section known as the Bill of Rights:

Fourth Amendment – Protection from unreasonable search and seizure.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Notice that the Fourth Amendment prohibits unreasonable search and seizure. This was put in place because of resentment with the police and military power of the British government. This has been one amendment that the US Supreme Court has allowed to be more and more compromised over the years. One example would be the Supreme Court declaration that supposedly one has no right to the presumption of privacy when driving one’s own automobile. And there have been others. And now this.

Now, just for being detained, whether or not you committed any crime, your DNA can be seized and analyzed by the police. The USA is really setting the stage for the European Beast power to trample over human rights for the good of the State.

What most in the USA do not realize is that they have almost no rights anymore. The trend (with few exceptions) is that the government is given more rights and control and those inside the USA can do little, if anything, about it.

The USA is the land of the expanding government and the home of the regulated. The USA ceased to be the land of the free and the home of the brave some time ago (the “Patriot Act” was perhaps the most blatant proof), yet its residents do not seem to understand what is really happening.
